Revised Circular on Ombudsman Clearance

  1. Inclosed is a copy of Memorandum Circular No. 10 dated January 24, 1995 of the Office of the Ombudsman revising its existing guidelines on the issuance of the Ombudsman clearance.
  2. Attention is invited to the penultimate paragraph of said Memorandum Circular which says that a person retiring from the government service whether optional or compulsory, needs only to present a certification from the Office of the Ombudsman whether or not he has a pending criminal or administrative case. In the event the certification presented states that the prospective retiree has a pending case, the head of the department, office or agency concerned has the responsibility if determining whether to release his retirement benefits, as well as the imposition of necessary safeguards to ensure restitution thereof in the event the retiree is found guilty.
  3. Please be guided accordingly.
